If anyones interested....
It was the motherboard limiting things, I got a cheap gigabyte p35-ds3 v2.1 off The Bay and CPU clocked up at 3ghz without missing a beat with minimal additional changes 0.1 on fsb and 1.25 on vcore@400fsb iirc. Just stress testing at the moment and no issues at all.
